The cost depends on the type of claim and how it is funded, but many actions against the police can be pursued under a No Win, No Fee (Conditional Fee Agreement). This means you do not pay anything upfront.

If your claim is successful, a percentage of your compensation and/or costs recovered from the police will cover your legal fees. If your claim is not successful, you typically pay nothing.

A reputable firm will be transparent about costs from the beginning. Potential costs may include:

  • Fees for medical or expert reports
  • Court fees (if the case goes to court)
  • Insurance to protect you from paying the police’s legal costs if you lose (ATE insurance)

Under No Win, No Fee arrangements, these costs are usually only payable if the claim succeeds — and many are covered by the police if the case is won. Your solicitor should clearly explain what applies in your case.

    • You pay nothing upfront
    • You do not pay your solicitor if the case is unsuccessful
    • If you win, your solicitor’s fees are paid from a combination of:
        • the costs the police must pay, and

        • a capped success fee taken from your compensation

ATE (After The Event) insurance is a policy taken out after your case begins. It protects you from having to pay the police’s legal costs if your claim is unsuccessful.
