Road Traffic Accidents – Whiplash Injury
Have you been in a road traffic accident that wasn’t your fault, and suffered a whiplash injury as a result? You could be entitled to claim compensation.
What is whiplash?
Sometimes a sudden road traffic collision can cause a soft tissue injury in and around the neck area. If you suddenly come to a harsh stop, your head will snap backwards and forwards, causing pain.
How long whiplash lasts varies, some people are okay after a few days, while others endure permanent damage.
Symptoms of whiplash may include:
- Neck pain and stiffness
- Pain increase when moving the neck
- Decrease of motion range in the neck
- Shoulder pain
- Arm tingling or numbness
- Dizziness and fatigue
How much compensation can I expect from a whiplash injury?
There is no typical whiplash settlement. Whiplash injury compensation amounts vary depending on the severity of the injury, as well as whether or not it has had an impact on your everyday life. For example, if you suffer a minor injury and you recover fully in a couple of months, the compensation you receive will be much less than that of a person who has more serious ongoing problems.
Whiplash accident claim time limits
The standard time you have to make your whiplash accident claim is three years from the date of the accident. However, there are two exceptions to this rule:
- A whiplash claim on behalf of a child can be made at any point until the child turns 18. After that, you can make a claim for a whiplash injury that occurred in childhood up until their 21st birthday.
- If your whiplash injury occurs outside of the UK, please be aware that the time limits may be shorter than that of UK law. Please familiarise yourself with this before making your claim.
