Indecent Assault

Indecent assault offence is generally defined as “unwanted sexual contact” but does not extend to sexual assault or rape. Anything physical that could be construed in a sexual way and has been undertaken without the victim’s consent could be considered indecent assault.

• Touched or manhandled a part of their body in a sexual manner without consent
• Interacted with them physically in any other way to which they did not consent
• Assaulted them by penetration with a foreign object

What constitutes indecent assault?

This offence may involve unwanted sexual contact, sexual activity with an underage person, forcing a person into non-penetrative sexual activity or making them watch sexual activity against their will, or engaging in sexual activity with a vulnerable person or one who is unable to legally give their consent. 

What is aggravated indecent assault?

This term refers to circumstances of assault that automatically make the crime more severe. This may include the use of violence or a weapon, the drugging of a victim, abuse of power or position or the existence of previous offences of a similar kind.
